Protecting Your Credit Under the Debt Bondage Repair Act
If you’re a survivor of human trafficking, you may be eligible for new protections that can help clear credit report information related to your trafficking experience. These rights were established by the Debt Bondage Repair Act, signed into law in December 2021 and effective as of July 25, 2022.
Are You Eligible?
You may qualify for these protections if you’ve experienced:
Sex Trafficking
Being recruited, transported, harbored, or solicited for a commercial sex act—especially if force, fraud, or coercion were involved.
Labor Trafficking
Being forced or deceived into labor, debt bondage, or involuntary servitude.
Steps to Remove Trafficking-Related Items from Your Credit Report
To request the removal (or “blocking”) of negative information caused by trafficking, you’ll need to submit:
Step 1: Proof of Identity
Provide the following:
- A government-issued photo ID (driver’s license, state ID, or passport)
- A recent utility bill, bank statement, or insurance statement showing your name, current address, and date
- Please make sure your documents are clear and legible.
- Do not send checks, lease agreements, magazine subscriptions, or forwarding orders—they won’t be accepted.
Also include:
- Your full Social Security number
- Your date of birth
- Your addresses from the past two years
Step 2: Proof You Are a Survivor of Trafficking
Acceptable documentation includes:
- A court determination
- A letter or documentation from a federal, state, local, or tribal government agency
- Documentation from an NGO (Non-governmental organization) or anti-trafficking task force
- A self-attestation signed by an authorized representative of one of the organizations above
Step 3: Statement of Affected Credit Information
Identify which items on your credit report were the result of trafficking.
You can use your own statement or refer to a sample letter for guidance.
